The Presidential Electoral Tribunal (PET) ordered former senator Ferdinand “Bongbong” Marcos Jr. to pay Php 63 million for vote recounting to be paid by installment of Php 33 million before April 14, 2017 (Friday) and Php 30 million before July 14, 2017 (Friday).
Manila Times quoted a source of theirs at the Supreme Court that said Chief Justice Lourdes Aranal-Sereno “hostaged” the release of the resolution which indicated the payment scheme Marcos needed to make, thus making it difficult for the former senator to pay on time.
The source added that the court en banc ruled on Marco’s poll protest way back in March 21, 2017, however, Marcos’ lawyer George Erwin Garcia only received the resolution on April 10, 2017 (Monday).
“Inipit ni Sereno yung resolution ni Bongbong. Biruin mo March 21 pa na en banc yan tapos ilalabas niya kung kailan Holy Week para gipitin si Bongbong sa pagbabayad ng protest nya,” the unnamed source said.
By rule, if Marcos is unable to pay on time, his poll protest will be dismissed.
Luckily, the Rules of Court state that “if the last day to comply with the order of the court falls on a holiday, the payment or compliance shall be made on the next working day.”
In the case of Marcos, while he is given only until April 14, 2017 (Friday) to pay Php 33 million, the Rules of Court will allow him to pay on April 17, 2017 (Monday) due to the holy week holidays.
Vice President Leni Robredo is also ordered to pay for the poll protest. She is to pay Php 15.4 million to be paid by installment of Php 8 million on or before April 14, 2017 (Friday) and Php 7.4 million on or before July 14, 2017 (Friday).
The process for Marco’s poll protest case is that a ponente will make the resolution draft agreed on during the en banc. After which, the draft will be sent to the chief justice for approval before it is released.
The ponente is Associate Justice Alfredo Benjamin Caguioa.
